General Terms and Conditions (GTC)

for dog training with Gina Bullwinkel, Danziger Straße 81, 10405 Berlin, Germany (hereinafter “trainer”)

§ 1 Scope

(1) These GTC apply to all contracts for dog training services between the trainer and her clients (hereinafter “client”).
(2) Deviating terms of the client only apply if the trainer expressly agrees to them in writing.

§ 2 Services

(1) The trainer offers in particular:

  • a free introductory call (online)
  • an initial consultation (on site or online)
  • one-to-one training (on site or online) and online training
  • packages of several training hours
  • group training and social walks
  • Dog Walk (group walk with pick-up, as a monthly subscription) and individual walks

(2) The content, location, duration and price of each service result from the service description on the website or the booking page, or from the individual agreement.
(3) Dog training is a service. No particular training success is owed, as this depends largely on the cooperation of the client and on the dog.
(4) For on-site appointments more than 3 km from the trainer’s home, a travel fee of €0.50 per kilometre is charged. It is invoiced separately.

§ 3 Conclusion of contract

(1) Appointments can be booked via the online booking on gina.berlin (scheduling tool zeeg), by email, phone, WhatsApp or in person.
(2) Online booking: The client chooses the service, date and location, answers the questions and enters their contact details. Before submitting, they can check and correct all entries. By clicking the booking button – for paid appointments “book with obligation to pay” or after completing the payment – the client makes a binding offer. The contract is concluded when the booking is confirmed by email; confirmation is usually sent automatically and immediately. The confirmation contains the booking details and a link to cancel or reschedule; these GTC can be viewed at any time at gina.berlin/en/gtc. The contract languages are German and English.
(3) For bookings made in any other way, the contract is concluded when the trainer confirms the appointment (usually by email or WhatsApp).
(4) Packages are agreed in the initial consultation. The contract is concluded with the confirmation of the package and the invoice. Payment in instalments is possible by arrangement; the agreed instalment plan then applies. The individual appointments of a package are arranged directly with the trainer or via a separate booking link.
(5) Group training, social walks, Dog Walk and individual walks are booked on request (contact form, email, phone or WhatsApp). For the Dog Walk, the contract is preceded by a free get-to-know-you walk and a trial walk; details such as term, notice and how cancellations are handled are agreed in text form when the dog joins the group.

§ 4 Prices and payment

(1) The prices stated on the website or the booking page at the time of booking, or agreed individually, apply. All prices are final prices including statutory VAT.
(2) Paid appointments booked online are paid via PayPal when booking. The client then receives an invoice by email.
(3) Packages, group training, social walks, Dog Walk, individual walks, travel fees and cancellation fees (§ 5) are invoiced. Unless otherwise agreed, invoices are payable within 7 days without deduction – by bank transfer or PayPal.
(4) Refunds (§§ 5, 6) are made using the same means of payment, usually within 7 days.
(5) If the client is in default of payment, the statutory provisions apply.

§ 5 Cancellation and rescheduling by the client

(1) Appointments can be cancelled or rescheduled free of charge up to 2 hours before they start – via the link in the booking confirmation, by email, phone or WhatsApp; the time of receipt is decisive. If the appointment has already been paid, the full price is refunded for timely cancellations.
(2) For later cancellations (less than 2 hours before the start), a cancellation fee of €25 is due. For appointments already paid, it is deducted from the price and the rest is refunded; for free appointments, it is invoiced.
(3) If the client does not attend the appointment without cancelling, the full price of the appointment is due. For free appointments, the cancellation fee of €25 is charged in this case.
(4) Paragraphs 2 and 3 also apply to the free introductory call. The cancellation fee is expressly pointed out when booking.
(5) If an appointment from a package is cancelled less than 2 hours before the start, a cancellation fee of €25 is charged; the hour remains in the package. If the client does not attend without cancelling, the hour counts as used.
(6) The client is entitled to prove that the trainer has suffered no damage or significantly less damage.
(7) If the client is late, the session is shortened accordingly; the fee remains unchanged.
(8) For the Dog Walk, the rules agreed when the dog joins the group apply (§ 3 (5)).
(9) The statutory right of withdrawal (§ 7) remains unaffected by these provisions.

§ 6 Cancellation by the trainer

(1) The trainer may cancel or reschedule appointments for good cause (e.g. illness, severe weather endangering people and dogs, force majeure). She will inform the client as early as possible and offer an alternative appointment.
(2) Amounts already paid for cancelled appointments will be refunded in full or credited, at the client’s choice; package hours that are cancelled remain in the package.

§ 7 Right of withdrawal for consumers

Withdrawal information

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period will expire after fourteen days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform me (Gina Bullwinkel, Danziger Straße 81, 10405 Berlin, Germany, phone +49 173 9135269, email hello@gina.berlin) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal
If you withdraw from this contract, I shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which I am informed about your decision to withdraw from this contract. I will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay me an amount which is in proportion to what has been provided until you have communicated to me your withdrawal from this contract, in comparison with the full coverage of the contract.

Early expiry
The right of withdrawal expires when the service has been fully performed and performance only began after you gave your express consent and at the same time acknowledged that you will lose your right of withdrawal once the contract has been fully performed.

§ 8 Requirements for participation

(1) The dog must have liability insurance, be adequately vaccinated and be free of contagious diseases. Vaccination and insurance certificates must be presented on request.
(2) Before the first appointment, the client informs the trainer about all health restrictions and behavioural particularities of the dog, in particular aggressive behaviour or previous biting incidents.
(3) For group offers (group training, social walks, Dog Walk), the dog must get along with other dogs. Females in heat only take part by prior arrangement.
(4) For the Dog Walk, the dog must also be dewormed and wear a well-fitting harness.
(5) Minors only participate when accompanied by a parent or guardian.

§ 9 Obligations during training

(1) The client remains the owner and the person responsible for the dog during training. The client keeps the dog under control so that other people and animals are not endangered, and follows the trainer’s safety instructions.
(2) The client carries out exercises suggested by the trainer on their own responsibility – including between appointments.

§ 10 Liability

(1) The client is liable as the dog’s keeper for damage caused by the dog in accordance with the statutory provisions (Section 833 German Civil Code).
(2) The trainer is liable without limitation for damage resulting from injury to life, body or health and for damage caused intentionally or through gross negligence. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.

§ 11 Photos and videos

The trainer only uses photos or videos showing the client or their dog for the website or social media with separate consent, which can be withdrawn at any time. Refusing has no effect on the training.

§ 12 Data protection

The trainer processes personal data only to perform the contract. Details can be found in the privacy policy.

§ 13 Final provisions

(1) The law of the Federal Republic of Germany applies. For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory consumer protection provisions of the country of their habitual residence.
(2) Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
(3) This English version is a translation for convenience. In case of doubt, the German version applies.
